IMPERIAL PROCLAMATION N°37 - Creation of the Imperial Supreme Court of Atlia

His Imperial and Royal Highness, Prince-Regent Luis Marcel, on behalf of the Imperial Throne and the Imperial Senate under the seventh year of the reign of His Imperial and Royal Majesty, King Gerónimo II, DECLARES:

The creation of the Imperial Supreme Court of Atlia and the National Courts of Justice,

Creating in the Imperial Constitution CHAPTER XV – OF THE JUDICIAL POWER IN THE EMPIRE,

Creating the position of Supreme Minister of the Imperial Court, who will hear constitutional disputes, as well as disputes between individuals and corporations, that may arise within the empire.

ARTICLE I – CREATION OF CHAPTER XV – OF THE JUDICIAL POWER IN THE EMPIRE

Article 69

The Imperial Throne delegates the Imperial Judicial Power to an Imperial Supreme Court of Atlia and National Courts of Justice.

Article 70

The Imperial Supreme Court of Atlia shall be composed of the Supreme Minister of the Imperial Court, who acts and judges on behalf of the Imperial Throne. His or her choice must be nominated by the Imperial Throne and approved by the Imperial Senate with an absolute majority. The Supreme Minister of the Imperial Court shall be responsible for carrying out all the responsibilities of the Imperial Supreme Court of Atlia.Para poder ser nominado como Supremo Ministro de la Corte Imperial se necesita:

                          I.          Be a full Atlian citizen.

                       II.          Possess extensive knowledge of macronational and/or imperial laws.

                     III.          Enjoy a good reputation both personally and within Atlian society.

                     IV.          Hold no office or legal responsibility outside the Atlian Empire, unless granted an exception by the Imperial Throne.

71.1 If the Supreme Minister of the Imperial Court should cease to be suitable for the position under consideration by the Imperial Government, resign or die, the Imperial Throne shall take over the responsibilities of the Supreme Minister of the Imperial Court until a new one is approved, within a period of no more than six (6) months.

Article 72

The responsibility of the Imperial Supreme Court of Atlia shall be to protect the constitutional order by interpreting the laws; resolving disputes that arise between individuals; intervening in disputes that arise when a law or act of authority violates individual rights; and resolving conflicts between authorities, for example, when they allege an invasion of their sphere of authority.

Article 73

The National Courts of Justice shall be responsible for mediating and ruling on issues related to the laws of each member state that do not have an impact on imperial laws. These shall be composed at the discretion of the executive offices of each member state.

The actions described in this imperial proclamation will take effect immediately after its publication.
