IMPERIAL PROCLAMATION°36 - Constitutionalization of Human Rights and the Catholic Faith in Atlia

His Imperial and Royal Highness, Prince-Regent Luis Marcel, on behalf of the Imperial Throne and the Imperial Senate under the seventh year of the reign of His Imperial and Royal Majesty, King Gerónimo II, DECLARES:
The creation of CHAPTER XIV ON HUMAN RIGHTS,
Adding the human rights that every person, whether a citizen of the Empire or not, will enjoy within the territory of the Empire,
Likewise, reforming CHAPTER X IMPERIAL IMAGERY, where the Roman Catholic religion is added as the ceremonial faith of the Atlian state.
ARTICLE I – CREATION OF CHAPTER XIV ON HUMAN RIGHTS
Article 45
Every person has the right to life in the Atlian Empire. No one may be sentenced to death or executed. Everyone has the right to respect for their physical and mental integrity.
Article 46
Torture and inhuman and/or degrading treatment or punishment are prohibited. No one may be subjected to torture or inhuman or degrading treatment or punishment.
46.1 Conversion therapy or any other therapy that may cause harm to any LGBTQ+ person is strictly prohibited and is considered a form of torture.
Article 47
Slavery is prohibited in the Atlian Empire; no one shall be held in slavery or servitude within its territory. No one may be forced to perform forced or compulsory labor. Everyone has the right to liberty and security of person.
47.1 Consequently, trafficking in human beings within Atlian territory is prohibited.
Article 48
Everyone has the right to respect for their private and family life, home, and communications.
Article 49
Everyone has the right to the protection of personal data concerning them.
49.1 Such data must be processed fairly for specific purposes and on the basis of the data subject's consent or some other legitimate basis established by law. Everyone has the right to access the data collected concerning them and to have it corrected.
49.2 Compliance with these rules will be subject to the supervision of an independent authority.
Article 50
Everyone has the right to marry and to found a family, which rights are guaranteed in accordance with imperial and macronational laws governing the exercise of these rights.
Article 51
Everyone has the right to freedom of thought, conscience, and religion. This right includes the freedom to change one's religion or belief and the freedom, either alone or in community with others and in public or private, to manifest one's religion or belief in worship, teaching, practice, and observance.
51.1 The right to conscientious objection is recognized, in accordance with the imperial and macronational laws that govern the exercise of this right.
51.2 Any religious activity that may involve harming a human being, animal and or living plant; as well as breaking any of the laws within the present Constitution and/or macronational law shall be forbidden.
Article 52
Everyone has the right to freedom of expression. This right includes the freedom to hold opinions and to receive and impart information and ideas without interference from public authorities and regardless of frontiers.
52.1 Freedom and pluralism of the media shall be respected.
Article 53
Everyone has the right to freedom of peaceful assembly and to freedom of association at all levels, particularly in political, commercial, and civic matters. This includes the right of everyone to form and join trade unions for the protection of his or her interests.
Article 54
Everyone has the right to education and access to vocational and continuing education. The Empire shall guarantee the provision of free compulsory education.
54.1 The freedom to establish educational establishments shall be respected with due respect for democratic principles and the right of parents to ensure the education and teaching of their children in accordance with their religious, philosophical and pedagogical convictions, in accordance with imperial and macronational laws governing the exercise of such freedom and right.
54.2 Academic freedom will be respected.
Article 55
Everyone has the right to work and to pursue a freely chosen or accepted profession.
Article 56
The freedom to conduct business in accordance with imperial atlian law and macronational laws and practices is recognized.
Article 57
Everyone has the right to own, use, dispose of, and bequeath their lawfully acquired possessions. No one may be deprived of their property except for reasons of public interest and in the cases and under the conditions provided by law, without prejudice to the timely payment of fair compensation for its loss. The use of property may be regulated by law to the extent necessary for the general interest.
57.1 Intellectual property will be protected.
Article 58
All are equal before the law of this Constitution.
58.1 Equality between women and men will be ensured in all areas.
Article 59
Any discrimination based on any grounds, such as sex, race, color, ethnic or social origin, genetic characteristics, language, religion or belief, political or other opinion, membership in a national minority, property, birth, disability, age, or sexual orientation, shall be prohibited.
LGBTQ+ persons are recognized and classified as a protected group, against whom discrimination or unfair disadvantage is strictly prohibited.
Within the scope of the Constitution and without prejudice to any of its specific provisions, all discrimination based on nationality is prohibited.
59.1 A hate crime shall be understood as any action that violates the integrity, rights and freedoms of a person when such action is motivated by prejudice regarding the victim's membership in a specific group, be it race, nationality, sexual orientation, gender or religious belief. These crimes will be prosecuted by the Imperial Supreme Court of Atlia and if found guilty, the offender may face suspension from any activity or group within the Empire or permanent revocation of citizenship.
Article 60
Respect for cultural, religious, and linguistic diversity is guaranteed.
Article 61
Children have the right to the protection and care necessary for their well-being. They may freely express their opinions. Such opinions shall be taken into account in matters affecting them in accordance with their age and maturity.
In all actions relating to children, whether taken by public authorities or private institutions, the best interests of the child shall be a primary consideration.
Every child has the right to regularly maintain a personal relationship and direct contact with both parents, unless this would be contrary to their interests.
61.1 Under this law, children are considered to be persons between birth and fifteen (15) years of age. From that age until the age of majority, that being eighteen (18) years of age are considered adolescents.
61.2 All minors, including children and adolescents, shall be recognized and classified as a protected group.
Article 62
The Empire recognizes and respects the rights of older persons to lead a dignified and independent life and to participate in social and cultural life.
Article 63
The Empire recognizes and respects the right of persons with disabilities to benefit from measures designed to guarantee their independence, social and employment integration, and participation in community life.
Article 64
The Empire shall maintain a high level of environmental protection, and the improvement of environmental quality must be integrated into its policies and guaranteed in accordance with the principle of sustainable development.
Article 65
The Empire's policies shall guarantee a high level of consumer protection.
Article 66
Every person has the right to a fair and public hearing within a reasonable time by an independent and impartial tribunal previously established by law. Every person shall have the opportunity to receive advice, defense, and representation. Free legal aid shall be made available to those without sufficient resources to the extent that such assistance is necessary to ensure effective access to justice.
66.1 Every accused person is presumed innocent until proven guilty according to law.
66.2 Respect for the rights of defense of every accused person shall be guaranteed.
Article 67
Any citizen of the Empire, and any natural or legal person residing or having their registered office in a member state, free associated state, protectorate, condominium, or territory, has the right to access the documents of the institutions, bodies, offices, and agencies of the Empire, regardless of the medium.
Article 68
Any citizen of the Empire and any natural or legal person residing or having their registered office in a member state, free associated state, protectorate, condominium, or territory has the right to petition their local legislature and/or the Imperial Senate.
ARTICLE II – REFORM OF CHAPTER X IMPERIAL IMAGES
Article 28
The Empire has amber, white, turquoise, and purple as its national colors. The Imperial flag, the imperial banner, the imperial coat of arms and the imperial seal, the coat of arms of the Senate, as so the Imperial Anthem, as well as the Royal Atlian Anthem are their national symbols.
28.1 The Imperial Flag of the Empire shall be a vertical tricolor of turquoise, white and amber with the Imperial Seal, which in its band has three stars, one for each member of the empire, crowned with the imperial crown on its crest; in the middle of the white bar of the tricolor.
28.2 The Imperial Anthem will be “Over The Waves” by Juventino Rosas.
28.3 The Royal Anthem will be “Dios Salve al Rey” by Augusto Izard.
28.4 The National Motto will be "Gloria Ex Memoria" (Glory From Memory)
28.5 The Imperial Animal shall be the House Sparrow (Passer domesticus)
28.6 The official religion will be ceremonially Roman Catholicism, as it is the faith professed by the Imperial Family and the majority of the population of the Empire at the time of the drafting of this Constitution.
ARTICLE III – CHANGE OF CHAPTER XIV GENERAL PROVISION
CHAPTER XIV GENERAL PROVISION will cease to have a number, and its only article will become “Sole Article”.
The actions described in this imperial proclamation will take effect immediately after its publication.
